Cabinet Filing’s General Terms and Conditions of Trade


These General Terms and Conditions of Trade ("Terms") form part of any contract or order ("order") between any customer ("the Customer") and Cabinetfiling.co.uk for the supply of goods and services ("goods"). The Customer shall be deemed to be aware of these Terms and buys subject to them whether or not the Customer has actually seen them. In the event of a conflict with the Customer's own Terms, Terms will prevail, except as otherwise stated. We have tried to keep our Terms and Conditions as clear as possible and give you all the information we can about your online transactions so that you completely understand the whole process, from ordering your filing cabinets to delivery.  It is extremely important to us that your online shopping experience meets expectations, so please take your time and read on. 


Contract after you have ordered

Firstly, you can correct any input error mistakes made during your order up until you confirm your final payment.

Once you are happy everything is correct and you have submitted an order you will be given an Order Reference Number and details of the filing cabinets you have ordered. You will then receive an email confirmation receipt of your order. This email is when our contract begins with you.  If under any circumstance we have to cancel your order or part of your order, we will contact you as soon as possible.

If a mistake is made in publishing inaccurate information on the site (e.g. the price, description or availability of a filing cabinet you have ordered), we may have to cancel your order at any time up to the point we send you the filing cabinet(s), even if you have received your Order Confirmation email.  In this instance you will receive a full refund of any charges already paid.  At cabinetfiling.co.uk we constantly strive to maintain the accuracy of information with regular updates and check on our products.  We ask customers to remain vigilant should such rare circumstances occur.


Prices & Payment

The final total cost of your order will be comprised of the price of the filing cabinet(s) ordered, VAT and the delivery charges (£15 per order). The prices of all our filing cabinets will be quoted as on the site, excluding VAT and delivery costs, these charges will be added to your order at the checkout. All of our prices are in UK pounds and payments are only deducted once an order is submitted. To protect both you and ourselves from fraudulent activities we may use certain information about yourself, when decided whether to accept your order.


Service Availability

We do not accept any orders out with the United Kingdom. Cabinetfiling.co.uk is intended only for use by residents in the United Kingdom.


Your Status

When placing an order through Cabinetfiling.co.uk you authorise that: 

- You are able to legally enter into binding contracts

 -You are at least 18 years of age

 -You reside in the United Kingdom


Binding Contract

You the customer can order filing cabinets from cabinetfiling.co.uk at any time convenient to yourselves. Your order composes a bid to buy a product, subject to acceptance of the order by us, we will send an email confirming the product has been ordered successfully (Order Confirmation). On receipt of the Order Confirmation the Contract will be formed.

If in the rare case that the products ordered and out of stock or no longer available we will provide a list of goods which we believe have a similar quality. Only if you are happy with the substituted goods will we proceed with the order. If the substituted goods are not to your satisfaction on arrival, we will cancel your order and will arrange collection of the products from yourself.


Warrant and Liability

We promise to you the customer that any filing cabinet(s) purchased through out site are fit and of satisfactory quality.


Our liability

Our liability for losses you may suffer as a consequence of us breaking the Contract is limited to the price of the product which you have purchased and any losses which are a predicted result of us breaking the Contract. Losses may be anticipated where they are predicted by both yourselves and ourselves at the time your order is deemed as accepted by ourselves.

Despite the rest of these terms, nothing limits our liability to you.

  • Death/personal injury caused by our negligence
  • Under section 2(3) of the Consumer Protection Act 1987  
  • For fraud/fraudulent misrepresentation
  • Any issue for which it would be illegal for us to prohibit or attempt to exclude, our liability.

When entering into a contract with a supplier through the cabinetfiling.co.uk, please note that the seller/suppliers particular liability will be found in their own terms and conditions


Refunds Policy

If for any reason you no longer want your chosen product, you have the right to cancel your order within 7 days of receipt of goods.  You will be offered a refund as long as the product is unopened and in its original packaging.  

In line with The Distance Selling Regulations we will accept products back within 7 days of receipt of goods, dispite being opened as long as the products are in "as new" condition and returned in original, undamaged packaging including any accessories or tools received with the goods.

Products should be inspected on delivery, any damage that may have occured to the product whilst in transit should reported to us within 3 working days.  Dispite being opened as long as the products are in "as new" condition and returned in original, undamaged packaging including any accessories or tools received with the goods, we will arrange for a replacement product to be sent out and for the damaged product to be collected.

Returning Your Goods

If you would like to return your goods you must contact us via email at enquiries@cabinetfiling.co.uk with your order reference number, along with your delivery details so we can arrange foe the collection of the product.  Refunds will take 3-5 working days to be credited back into you payment account.  

If on inspection of the product on return to ourselves, we cannot refund or cancel your purchase.

Delivery dates quoted in the Customer Order Confirmation and/or Invoice is estimated by way of indication only and Cabinetfiling.co.uk shall not be liable for any losses due to inability to meet delivery dates.  In the order confirmation email we will make you aware of the delivery method we are going to use. However if you buy a number of items it is possible that you will receive your goods separately.  For large orders we will inform you about delivery dates as part of the order process. 

We deliver to the mainland UK and the following islands: Isle of Skye, Isle of Sheppey, Anglesey and Isle of Wight. Unfortunately we cannot deliver to the Channel Islands, Western Isles or Isle of Man.  We cannot deliver small or large items to BFPO (British Forces Post Office) addresses.

The goods will be at Cabinet Filing’s risk until delivered to the customer from delivery all risks pass to the customer. All deliveries should be checked by the customer promptly. If the goods are received by the customer damaged or short delivered Cabinetfiling.co.uk must be notified within 7 calendar days of delivery. Cabinet Filing shall have no liability for any consequential and economic loss under this order whatsoever arising.


Written Communications

Since applicable laws require the majority of information or communications should be in writing, when using the Cabinetfiling.co.uk you agree that communication with us will be mainly electronic.  Contact will be via email or we will provide you with information via notices on our website. When agreeing to the terms of conditions you are binding a contract with ourselves, you acknowledge that all contracts and information we provide to yourselves conform to any legal requirement that such communications should be in writing and you agree to this electronic means of communication. This condition does not affect your statutory rights.

Please note that all information and communications with Cabinetfiling.co.uk will be in English.


Transfer of Rights and Obligations 


Any contract formed between aforementioned parties is binding on both you, the customer and cabinetfiling.co.uk and on our successors and assigns.


 You may not transfer, charge, assign or dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent.

We can transfer, assign, charge, sub-contract or dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.


Events outside Our Control


Cabinetfiling.co.uk will not take liability or responsibility for any delay in performance or failure to perform any of our obligations if the contract is disrupted by events outside the companies control that are deemed by the reasonable person to be unforseen circumstances.

-Strikes, lock outs or any other industrial action

-Terrorist attack, war, civil commotion

-Interruption of used of shipping, railway or motor transport

-Interruption of public or private telecommunications

-Earthquakes, fire, explosion of any other natural disaster.

Performance under any is suspended until said unforeseen event has be rectified.


Our Right to vary these Terms and Conditions


To reflect changes in market conditions affecting our business for example  changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our systems capabilities we have right to amend these Terms.

You the customer will be subject to the Terms applicable to you at the time that you order the product from us.


Festive Period

During the festive period of 2012, Cabinet Filing offices will be closed from the 18th of December through to the 7th January.  Any orders place during this period will not be processed until the 7th January 2013.
